Can a company claim they are the
ONLY source for an item?
Sure, anyone can claim anything.
What you have to sort out is the
agenda of the person making the claim. Why they are making the claim, particularly if it
is not easy for you to verify, has a meaning.
If a person claimed they were
the only source for a "pair of pliers," you would immediately know that was
wrong since you can buy pliers from a lot of different sources, in all different shapes,
and so on. You probably have pliers with assorted trade marked names in your tool box.
I know I do. Since it is so easy to see through the claim of bring the only source for a "pair of
pliers" that no one would make the claim. However, if you are not
aware of the facts in the claim, how can you be sure it is real...
If the purpose of making the
claim is to get you to buy now, that is the agenda of the person making the claim. In many
instances, the claim of being the only source should set of an alarm for you.
To a point, if a person has a
Trade Mark they can claim they are the only supplier of that item by that trade
marked name. To
the extent a true trade mark exists as referenced, then it is appropriate that only the
company owning the trade marked name can sell the product under that trade marked name.
However, claiming to have a
Trade Mark and actually having a Trade Mark is a different story.
Having a Trade Marked name does
not prevent another supplier from selling the same product under a different name. It
happens all the time. How many companies do you know that sell Pliers or Screw Drivers? They all
sell under a Trademarked name and the design of the pliers or screw driver is the same.
Does this mean the other
companies are offering a counterfeit product? Not at all.
Does this mean the other
companies are offering a lower quality product? Not at
all.
We make assorted components of
our Gold Plating System. Take our solid stainless steel anode and solid stainless steel
anode holders. We could call them some special name and trade mark the special name, lets
say "wingdings," and properly claim we are the only company that can offer the
"wingdings" under that trade mark name. That would be technically correct.
The point of being correct in
claiming we are the only company who can sell the "wingdings" under the
"wingding" trade mark name would not stop any other company from making the
exact same solid stainless steel item on their own and calling them something else. Or
just calling them exactly what they are by a descriptive name, solid stainless steel
electrodes and solid stainless steel electrode holders.
Actually, there is little that I
know of in the Gold Plating Industry that is the exclusive property of any one company. I
know of many companies offering identical products using different descriptions.
Since the driving force behind
the information given out on the Internet is to sell you something, the ability to claim
by a particular supplier that they are the only source for a particular item may give them
an edge, if you accept the statement without checking out the information.
As just stated, there is little
that I know of in the Gold Plating Industry that is the exclusive property of any one
company. Other companies may not offer the same item for different reasons, but not
particularly because they can not offer the item.
Picture the stainless
steel grounding tray to go into the drain pan. Several companies offer it. We
could offer
it. We choose not to offer it. The reason we choose not to offer it is based on a very
limited value top our customers. Most of the gold plating is done on scripts and emblems while they are on
the vehicle. The same is true of other items on Boats, Airplanes, plumbing fixtures and so
on. Most all of the items are attached to something else. Since you can not, or do not
want to, remove the items before you gold plate them, there is no need for a grounding
tray.
Next, if you do a small piece, as we have done so often, we hold the piece in our
hands (while we chemical gloves) as we do the work so we can be sure that we are thorough
in our coverage on the entire piece. In all of the gold plating I have done, I have never
needed to use a grounding tray and it seems illogical to ship you, and CHARGE YOU, for an
item you do not need.
From a practical standpoint, I
expect the Energizer Rabbit is a well recognized symbol. The aspect of the bunny being
either cute or an irritation depends on your point of view. The other item is that there
are an assortment of batteries on the market.
Which one is best?
They all seem to claim they are
the best in one way or another.
The bunny keeps on going, and
going, and going.
Nothing can beat the copper top.
Better than the battery
controversy, what about all of the different phone companies, they all claim they are the
best as well. Each seems to offer some twist on things and it is quite hard to really know
the difference.
The
fine print can be hard to read and understand.
